PLEASE READ THESE TERMS AND CONDITIONS OF SERVICE ("TERMS") CAREFULLY BEFORE USING THE SERVICES, WEBSITE, OR INTERACTING WITH Don C. Hull ("AGENT", "WE", "US", OR "OUR") OPERATING AS A SOLE PROPRIETORSHIP.

BY ACCESSING OUR WEBSITE, SUBMITTING AN APPLICATION, PROVIDING YOUR PHONE NUMBER OR EMAIL ADDRESS, OR OTHERWISE ENGAGING OUR SERVICES, YOU ("CLIENT", "YOU") AGREE TO BE BOUND BY THESE TERMS, INCLUDING OUR PRIVACY POLICY AND SMS POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE OUR SERVICES.


1. BUSINESS STRUCTURE AND CAPACITY

1.1 Sole Proprietorship

Don C. Hull operates as an independent insurance agent and as a sole proprietorship. You understand that you are contracting directly with Don C. Hull, not a corporation or LLC, unless otherwise specified in writing.

1.2 Independent Contractor

Agent is an independent contractor and not an employee, partner, or joint venture of any insurance carrier whose products are offered. Agent holds necessary licenses to solicit insurance in the state(s) of. Arkansas, Colorado, Georgia, Louisiana, North Carolina, Neveda, Ohio, Oregon, Texas Virginia, Washington, New Jersy, Illinois, Michigan and Oklahoma.

1.3 Limitation of Authority

Agent has the authority to solicit applications for insurance policies but does not have the authority to bind coverage, alter policy terms, or accept premium payments directly, unless specifically authorized in writing by the insurance carrier.


2. SERVICES PROVIDED

2.1 Professional Advice

Agent provides insurance advisory services based on information provided by the Client. Agent strives to recommend policies that suit the Client’s disclosed needs.

2.2 No Guarantee of Approval

Agent does not guarantee that any insurance carrier will approve an application for coverage. Approval and premium rates are determined solely by the underwriting department of the respective insurance carriers.

2.3 Accuracy of Information

Client is solely responsible for the accuracy and completeness of all information provided to the Agent. Misrepresentations or omissions on applications can lead to denial of coverage or rescission of the policy.


3. SMS/TEXT MESSAGE AND TELEMARKETING POLICY (A2P 2026 COMPLIANT)

3.1 Consent to Communication

By providing your phone number, you expressly consent to receive communications from Agent via telephone call, artificial or pre-recorded voice, and SMS/text message at the number provided.

3.2 A2P 10DLC Compliance

In compliance with 2026 A2P (Application-to-Person) 10DLC (10-Digit Long Code) standards, Agent ensures that all text messages are authenticated and secure.

3.3 One-to-One Consent

Agent requires explicit, "one-to-one" consent for marketing messages. By opting in, you acknowledge that you are providing direct consent to be contacted by [Insert Your Name] specifically, and not a third-party aggregator.

3.4 Message Frequency

Message frequency varies based on your interactions and requests (e.g., application updates, appointment reminders, policy renewals).

3.5 Opt-Out Instructions

You may opt out of receiving text messages at any time. To stop receiving text messages, reply STOP to any message you receive from us. After you reply STOP, we may send you one additional message to confirm that you have been unsubscribed.

Message and data rates may apply according to your wireless carrier’s rate plan.

3.8 No Sharing of Mobile Data

4. PRIVACY AND DATA PROTECTION

4.1 Data Collection

Agent collects personal information necessary to solicit insurance, including name, address, Social Security number, health information, and financial data.

4.2 Data Security

Agent utilizes industry-standard administrative, physical, and technical safeguards to protect Client data. However, no data transmission over the internet or storage system is 100% secure.

4.3 Use of Information

Your data is used solely to facilitate the insurance application process, service your policy, and comply with legal obligations. We do not sell your personal information.


5. FEES AND COMPENSATION

5.1 Agent Commission

Agent is compensated through commissions paid directly by the insurance carriers upon the sale and placement of insurance policies.

5.2 No Fee for Service

Unless specifically disclosed in a separate written agreement signed by the Client, Agent does not charge the Client a fee for advisory services.


6. LIMITATION OF LIABILITY AND CARRIER DISCLAIMER

6.1 No Liability for Carrier Actions or Decisions

Agent acts solely as an intermediary between the Client and the insurance carriers. Agent is not liable for the acts, omissions, underwriting decisions, coverage interpretations, claims processing, or financial stability of any insurance carrier whose products are recommended or sold.

6.2 No Guarantee of Approval or Coverage

Agent does not guarantee that any insurance carrier will approve an application for coverage, nor does Agent guarantee the premium rates or specific terms offered by a carrier. All coverage decisions are made solely by the carrier’s underwriting department.

6.3 Scope of Coverage Disputes

In the event of a dispute regarding coverage, policy interpretation, or claim denial, the Client must resolve the dispute directly with the insurance carrier. Agent is not responsible for policy exclusions, limitations, or the carrier’s refusal to pay a claim.

6.4 Errors and Omissions (E&O)

Agent maintains Errors and Omissions insurance coverage. In the event of a claim substantiated by a court of competent jurisdiction regarding the Agent's professional negligence, Client’s recovery is strictly limited to the limits of the Agent’s E&O policy.

6.5 Disclaimer of Consequential Damages

To the maximum extent permitted by applicable law, Agent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from the services provided, even if Agent has been advised of the possibility of such damages.


7. GOVERNING LAW AND DISPUTE RESOLUTION

7.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles.

7.2 Dispute Resolution

Any dispute arising from these Terms or the services provided shall be resolved through binding arbitration in City of New Orleans, Orleans Parish, State of Louisiana administered by the American Arbitration Association under its Commercial Arbitration Rules.


8. TERMINATION AND MODIFICATION

8.1 Modification of Terms

Agent reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with the revised "Effective Date." Your continued use of our services constitutes acceptance of the modified Terms.

8.2 Termination of Services

Either party may terminate the relationship at any time. Termination does not relieve the Client of obligations regarding policies already placed or information already provided.

10. ELIGIBILITY AND AGE RESTRICTION

10.1 Minimum Age

By engaging our services, you represent and warrant that you are at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is older.

10.2 Legal Capacity

You must possess the legal capacity to enter into a binding contract to apply for insurance products through the Agent. If you are under the age of 18, you may not submit personal information or engage our services.
